Contract Terms
This User Agreement, and all of its terms and conditions, constitute a legal contract between you and Environmental Toner Brokers Inc. (References to “you” or “your” shall relate to a customer of Environmental Toner Brokers Inc. or other party that visits, accesses, browses, shops, or otherwise uses the Site (the “Customer”); references to “Environmental Toner Brokers Inc.” shall relate to Environmental Toner Brokers Inc. and its affiliates.) By visiting, accessing, browsing, shopping, or otherwise using this site (“Site”), you acknowledge that you have read, understood, and agree to be bound by this User Agreement and comply with all applicable laws and regulations. If you do not agree to this User Agreement, as it may be changed by Environmental Toner Brokers Inc. from time to time, do not use this Site. The material provided on this Site is protected by law. This Site is controlled and operated by Environmental Toner Brokers Inc. from its offices in Canada. Environmental Toner Brokers Inc. makes no representation that materials in the Site are appropriate or available for use in other locations, and access to them from territories where their contents are illegal is not authorized. Those who choose to access this Site from other locations do so on their own initiative and are responsible for compliance with applicable local laws.
Any claim relating to this Site and the use of the materials contained herein is governed by the province of Ontario without regard to conflict of law rules. You consent to jurisdiction of the federal and provincial courts located in Oakville, Ontario, Canada to hear any such claims.

Environmental Toner Brokers Inc. grants you a limited license to access and make personal use of the Site and not to download (other than page caching) or modify it, or any portion of it, except as provided below under “Use Restrictions,” or with express written consent of Environmental Toner Brokers Inc.. Communications to Environmental Toner Brokers Inc.
Any communication or material you transmit to the Site by electronic mail or otherwise, including any data, questions, comments, suggestions, or the like is, and will be treated as, non-confidential and non-proprietary. Anything you transmit or post may be used by Environmental Toner Brokers Inc. for any purpose, including but not limited to reproduction, disclosure, transmission, publication, and posting. Furthermore, Environmental Toner Brokers Inc. is free to use any ideas, concepts, or techniques contained in any communication you send to Environmental Toner Brokers Inc. or the Site for any purpose whatsoever, including but not limited to developing, manufacturing and marketing products using such information.

Environmental Toner Brokers Inc. Terms and Conditions of Sale
PLEASE READ THESE TERMS AND CONDITIONS OF SALE (“SALE AGREEMENT”) VERY CAREFULLY.
THE CUSTOMER AGREES TO BE BOUND BY THIS SALE AGREEMENT AND ACCEPTS ITS TERMS AND CONDITIONS (UNLESS THE CUSTOMER HAS SIGNED A SEPARATE FORMAL PURCHASE AGREEMENT WITH Environmental Toner Brokers Inc. IN WHICH CASE THE SEPARATE AGREEMENT SHALL GOVERN).
Important Information
This Sale Agreement is a legal contract between the Customer and Environmental Toner Brokers Inc.. The Customer accepts this Sale Agreement by making a purchase, placing an order, or otherwise shopping on the Site. (References to “you” or “your” shall relate to the Customer; references to “Environmental Toner Brokers Inc.” shall relate to Environmental Toner Brokers Inc. and its affiliates.) The terms and conditions of this Sale Agreement are subject to change without prior notice, except that the terms and conditions posted on the Site at the time the Customer initially places an order will govern the order in question.
This Sale Agreement constitutes the entire agreement between the Customer and Environmental Toner Brokers Inc. relating to the purchase or sale of goods or services on the Site. The Sale Agreement may only be modified or terminated with regard to goods or services that have been purchased or sold on the Site in a writing signed by Environmental Toner Brokers Inc.. Electronic records (including signatures), that are otherwise valid, shall be accepted under the Sale Agreement. The Customer consents to receiving electronic records, which may be provided via a web browser or e-mail application connected to the Internet; The Customer may withdraw consent to receiving electronic records or have the record provided in non-electronic form by contacting Environmental Toner Brokers Inc. at the address provided below.
In the event of any conflict between the terms and conditions stated on your purchase order and this Sale Agreement or any terms and conditions on our invoice, you agree that the provisions of this Sale Agreement and our invoice shall control.
Governing Law
THIS AGREEMENT AND ANY SALES HEREUNDER SHALL BE GOVERNED BY THE LAWS OF THE PROVINCE OF ONTARIO, WITHOUT REGARD TO CONFLICTS OF LAWS RULES. THE CUSTOMER CONSENTS TO THE JURISDICTION OF THE PROVINCIAL COURTS LOCATED IN OAKVILLE, ONTARIO, CANADA FOR PURPOSES OF ANY SUIT, ACTION OR PROCEEDING ARISING OUT OF THIS SALE AGREEMENT.
Risk of Loss
Title to goods herein being purchased is retained by the seller until goods are paid for by the purchaser and at that time title passes to the purchaser. Loss or damage that occurs during shipping by a carrier selected by Environmental Toner Brokers Inc. is not the responsibility of Environmental Toner Brokers Inc. If it fails to reach its destination The Customer must advise immediately and allow the courier firm at least seven (7) days to research the claim. This does not apply if The Customer refuses delivery without notice in advance to Environmental Toner Brokers Inc. If Environmental Toner Brokers Inc. determines they are at fault, your order will be replaced at no charge to you. Environmental Toner Brokers Inc. is not responsible for any delays that may occur in the shipping of your order, or for any orders stolen. No refunds, adjustments, or credits will be given for orders have been stolen.
Export Sales
If goods herein being purchased are being purchased for purposes of export, the Customer must obtain from the federal government certain export documentation before shipping to a foreign country. In addition, manufacturers’ warranties for exported goods may vary or even be null and void for goods exported outside of Canada. The Customer should inquire further regarding any questions. Any and all liability is only for the products purchased.
Warranty
ENVIRONMENTAL TONER BROKERS INC. HEREBY EXPRESSLY DISCLAIMS ALL WARRANTIES EITHER EXPRESSED OR IMPLIED, INCLUDING, WITHOUT LIMITATION, ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. THIS DISCLAIMER BY ENVIRONMENTAL TONER BROKERS INC. IN NO WAY AFFECTS THE TERMS OF THE MANUFACTURER’S WARRANTY, IF ANY.
Pricing and Information
All pricing is subject to change. For all prices, products and offers, Environmental Toner Brokers Inc. reserves the right to make adjustments due to changing market conditions, product discontinuation, manufacturer price changes, errors in advertisements and other extenuating circumstances.
Orders
Orders are not binding upon Environmental Toner Brokers Inc. until accepted by Environmental Toner Brokers Inc.. Terms of payment are within Environmental Toner Brokers Inc.’s sole discretion. Invoices are due and payable within the time period noted on the invoice, measured from the date of the invoice. Environmental Toner Brokers Inc. may invoice parts of an order separately. Customer agrees to pay interest on all past-due amounts at the highest rate allowed by law. The Customer is responsible for sales and all other taxes associated with the order.
Freight Policy
Shipping and handling charges on all orders vary; contact your Environmental Toner Brokers Inc. Exclusive Assistant for current and competitive rates, options, and shipping specials. In some circumstances, international shipping may be available. Call for details.
Return Policy
Warranty period is outlined at the bottom of invoice for each type of cartridge sold.
Credit Cards
Credit card charges are processed after ordering the products and/or services.
ETB Programs and Promotions:
ETB offers a number of promotions and programs as listed below. Multiple promotions and programs can not be combined for one order.
ETB Gift Certificate Program – Every order of Premium Remanufactured cartridges of over $500 before taxes is eligible for a $25 gift certificate. We currently offer gift certificates for either The Keg, Metro Groceries, Petro Canada and others.
ETB Referral Program – Each time an ETB client refers us to another company, the client will receive $100 in Gift Certificates or in ETB Premium Remanufactured cartridge credit when the other company places a first order of minimum of four (4) Premium Remanufactured cartridges.
ETB Price Match Guarantee – If an ETB client finds the same quality and size cartridge at a lower price from another company, ETB will match the price. The sale price from the other company must be a current advertised price, and not a discounted price due to membership in a loyalty or preferred client program. The ETB client must provide the price from the other company in writing (flyer, advertisement, or website) before purchase of the cartridges from ETB. The ETB Price Match Guarantee can not be used to issue a refund after the order has been placed with ETB. The price match guarantee takes into consideration all shipping and handling fees, in addition to any other charges applied by the other company.
Defective cartridges – If a cartridge is found to be defective within the warranty period specified on the invoice, ETB will replace the defective cartridge at no cost to the client. The client must provide a copy of the cartridge issue form and a print out from the printer in question before the cartridge will be replaced. Clients are expected to have knowledge of their printer, including approximately when the drum was last replaced (if applicable).
ETB No Frills Line – ETB offers a discount line of remanufactured cartridges. No other programs or promotions apply when you purchase from the No Frills Line. ETB will not accept unused No Frills cartridges back for credit. All No Frills purchases are final and must be paid COD.
ETB Environmental Reports – ETB clients can request an annual breakdown of materials their company saved from the landfills by purchasing Premium Remanufactured cartridges.
ETB Promotions – ETB offers regular promotions to clients, no purchase necessary. Check the website for details. If a promotion includes a draw for free tickets to an event, the winner of the tickets will be contacted by phone and email. The winner of the tickets must reply to the email or respond to the phone call to confirm receipt of the tickets. If Environmental Toner Brokers Inc. does not hear back from the winner of the tickets by 9am EST on the day of the event, a new draw will be held and the tickets will be given to the next winner of the draw.
